Overview

NestHaven Properties ("we", "us", "our") is committed to the protection of your personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA"). This notice explains what personal information we collect, why we collect it, who we share it with, how long we keep it, and your rights.

Information we collect

We collect:

  • Identifying information: name, contact details, ID or passport number where required for FICA.
  • Property-related information: addresses, financial information, valuations.
  • Communications: email, phone, WhatsApp messages with our practitioners.
  • Website analytics: IP address, browser, pages visited, referrer (only with your consent).

Purposes of processing

We process personal information to:

  • Respond to your enquiries.
  • Facilitate property transactions, including FICA and CIPC compliance.
  • Match buyers and tenants to suitable properties.
  • Issue and manage mandates.
  • Comply with the Property Practitioners Act, FICA, the FAIS Act, and tax law.
  • Send you newsletters and property alerts, where you have consented.

Legal basis

We rely on your consent, the performance of a contract, our legitimate interests in running our business, and legal obligations under the Property Practitioners Act and FICA.

Recipients of personal information

We may share your personal information with:

  • EstateAgently (Pty) Ltd, our CRM and operating system provider, as a processor.
  • Conveyancers and bond originators relevant to your transaction.
  • The South African Revenue Service (SARS) and other authorities where legally required.
  • Third-party portals (Property24, Private Property) where you have asked us to syndicate a listing.

Cross-border transfer

We do not routinely transfer personal information outside of South Africa. Where required (for example, where a buyer is foreign), we transfer only with your consent and to recipients in jurisdictions with adequate protection.

Retention

We retain personal information for as long as required by the Property Practitioners Act, FICA, the Tax Administration Act, and POPIA — typically five years from the date of the last transaction or interaction.

Your rights

You have the right to:

  • Access the personal information we hold about you.
  • Request correction or deletion.
  • Object to processing.
  • Withdraw consent.
  • Complain to the Information Regulator (info.regulator@justice.gov.za).
